Do these companies think their employees are escaped slaves?

I can’t even remember the last time I saw a dialup modem, much less used one. When was the last time you used one? Still use one?

Laugh all you want, but as of the end of September, AOL still had 3.5 million subscribers to its dialup Internet access service — a lot more than the number of people who pay for, say, Spotify. And the decline from last year — about 630,000 subs — was AOL’s smallest Q3 shrinkage yet. (AOL credits a “price rationalization program” last quarter that helped them convert 200,000 people to an AOL access subscription.) This time in 2006 and 2007, AOL was losing 5 million customers a year.

Imagine that President Obama could order the arrest of anyone who broke a promise on the Internet. So you could be jailed for lying about your age or weight on an Internet dating site. Or you could be sent to federal prison if your boss told you to work but you used the company’s computer to check sports scores online. Imagine that Eric Holder’s Justice Department urged Congress to raise penalties for violations, making them felonies allowing three years in jail for each broken promise. Fanciful, right?

Think again. Congress is now poised to grant the Obama administration’s wishes in the name of “cybersecurity.”

The little-known law at issue is called the Computer Fraud and Abuse Act. It was enacted in 1986 to punish computer hacking. But Congress has broadened the law every few years, and today it extends far beyond hacking. The law now criminalizes computer use that “exceeds authorized access” to any computer. Today that violation is a misdemeanor, but the Senate Judiciary Committee is set to meet this morning to vote on making it a felony.

The problem is that a lot of routine computer use can exceed “authorized access.”

Some of those issues were headed off, but that’s only some and who knows if the amendments will survive. Here’s the latest.

Sounds like HAL is a ways off yet, although this could make for a more interesting political talking head show than the ones on now.

What with low-margins and declining sales in the move to mobile devices where Apple is eating everyone’s lunch, there will probably be more of this to come.

Bloomberg reports that multiple sources are indicating that HP will spin off its PC business to focus on enterprise services. As part of that change in focus, it will be acquiring the Cambridge, UK-based data analysis company Autonomy for about $10 billion, a healthy premium over the company’s current market cap.

Although HP’s shift toward a service and consulting focus has been going on for years (we joked that it already looked a bit like IBM West a year ago), the decision to spin off its PC business is a bit of a surprise. After a rocky merger with Compaq, HP had grown to dominate global PC sales, and its purchase of Palm and WebOS had indicated it was at least trying to pursue options that could help keep it relevant as sales of compact touchscreen devices soared.

Nevertheless, the margins of the PC business have remained very narrow, and most of HP’s competition is either suffering or attempting to go upmarket (Dell being the primary example of the latter).

As many of you know I wrote a newspaper column in 1984 with a review of the Macintosh computer which was picked up on by Mac fan boys twenty years later and used to condemn me for not immediately falling in the love with the mouse in 1984 and questioning its future. Some people have gone so far as to misquote my commentary which was simply that it – the mouse – was experimental. The primary made-up attribution was that I didn’t want one of these “newfangled” devices. I never said any such thing and this sort of writing I never do. It was wishful thinking by someone hoping to make me look like an old fart, which might be true today, but was not 30 years ago! I’ve seen the misquote appear here and there and manage to get it pulled whenever possible. Anyone who uses it should be ashamed of themselves.

Curiously that 1984 column was re-addressed in 1987 when I was asked to reflect on the then old 1984 column. After the 1987 column I thought the matter was resolved and my take on the Mac corrected.

In hindsight I probably got more mileage out of this Mac Mouse topic than anything I’ve ever done, which is kind of pathetic, if you think about it. The fabled “My Dinner with IBM” comes in at number two. If anyone is interested I’ll dig up the original unedited version of that screed.

So while cleaning the closet I managed to run into an original clipping of the 1987 column for your perusal.

This explains a lot. And yet, as with all statistics, it doesn’t.

If you use Internet Explorer, your IQ might be below average–at least, according to one study.

AptiQuant, a “psychometric consulting” firm that provides hiring exams for businesses, gave online IQ tests to more than 100,000 people. Visitors arrived either through organic searches or through advertisements on other sites, and Aptiquant made a note of which browser each test taker was using.

On average, Internet Explorer users fared the worst, with IE6 users at the bottom of the pile and IE8 users performing slightly better. Firefox, Chrome and Safari fell in the middle with little difference between them. IE with Chrome Frame and Camino landed on top, along with Opera, whose users scored the highest (on average).

“The study showed a substantial relationship between an individual’s cognitive ability and their choice of web browser,” AptiQuant concluded. “From the test results, it is a clear indication that individuals on the lower side of the IQ scale tend to resist a change/upgrade of their browsers.”

This is like the “no anonymity” on the web campaign which is pushed as being anti-bullying, anti-predator, revenue enhancing (Facebook and other websites), etc, but would have the real effect of discouraging people who might be afraid of retribution if they say something online someone in power doesn’t like.

Internet providers would be forced to keep logs of their customers’ activities for one year–in case police want to review them in the future–under legislation that a U.S. House of Representatives committee approved today.

The 19 to 10 vote represents a victory for conservative Republicans, who made data retention their first major technology initiative after last fall’s elections, and the Justice Department officials who have quietly lobbied for the sweeping new requirements, a development first reported by CNET.

A last-minute rewrite of the bill expands the information that commercial Internet providers are required to store to include customers’ names, addresses, phone numbers, credit card numbers, bank account numbers, and temporarily-assigned IP addresses, some committee members suggested. By a 7-16 vote, the panel rejected an amendment that would have clarified that only IP addresses must be stored. It represents “a data bank of every digital act by every American” that would “let us find out where every single American visited Web sites,” said Rep. Zoe Lofgren of California, who led Democratic opposition to the bill.

Lofgren said the data retention requirements are easily avoided because they only apply to “commercial” providers. Criminals would simply go to libraries or Starbucks coffeehouses and use the Web anonymously, she said, while law-abiding Americans would have their activities recorded.

“The bill is mislabeled,” said Rep. John Conyers of Michigan, the senior Democrat on the panel. “This is not protecting children from Internet pornography. It’s creating a database for everybody in this country for a lot of other purposes.”

The federal government plans to shut 40 percent of its computer centers over the next four years to reduce its hefty technology budget and modernize the way it uses computers to manage data and provide services to citizens.

The Obama administration, in plans detailed Wednesday, is taking aim at some of that by closing 800 of its sprawling collection of 2,000 data centers. The savings, analysts say, will translate into billions of dollars a year and acres of freed-up real estate.

In an interview, Vivek Kundra, chief information officer for the federal government, explained that the data center consolidation was part of a broader strategy to embrace more efficient, Internet-era computing. In particular, the government is shifting to cloud computing, in which users use online applications like e-mail remotely, over the Internet. These cloud services can be provided by the government to many agencies or by outside technology companies.

Tapping cloud computing services, Mr. Kundra said, could save the government an additional $5 billion a year, reducing the need for individual government agencies to buy their own software and hardware.
