This isn’t about his citizenship, it’s about getting a court injunction barring him from becoming President until the issue can be resolved.

Let me repeat that, this lawsuit is about getting a legal injunction barring Obama from running for President until his citizenship status can be determined!

It’s not an option to allow Obama to become President and then figure out if he can be elected President. This has to be decided beforehand once the question has been raised.

Had not heard that before this posting. As a Fact matter, the case cannot be dismissed. So what we have is a very poorly developed legal argument that is being filed in a Pennsylvania district court. It alleges that either Mr. Obama was not born in the US or that he lost his citizenship when he was over in Kenya after being born in the United States. Wow…

He might actually want to take a long at the United States law on the subject. Here is the possible reasons to remove citizenship:

Citizenship and Naturalization – INA §349

(a)–A person who is a national of the United States whether by birth or naturalization, shall lose his nationality by voluntarily performing any of the following acts with the intention of relinquishing United States nationality -

(1)–obtaining naturalization in a foreign state upon his own application or upon an application filed by a duly authorized agent, “after having attained the age of eighteen years”; or

(2)–taking an oath or making an affirmation or other formal declaration of allegiance to a foreign state or a political subdivision thereof after having attained the age of eighteen years; or

(3)–entering, or serving in, the armed forces of a foreign state if (A) such armed forces are engaged in hostilities against the United States, or (B) such persons serves as a commissioned or non-commissioned officer; or

(4)–(A) accepting, serving in, or performing the duties of any office, post, or employment under the government of a foreign state or a political subdivision thereof after attaining the age of eighteen years, if he has or acquires the nationality of such foreign state; or (B) accepting, serving in, or performing the duties of any office, post, or employment under the government of a foreign state or a political subdivision thereof after attaining the age of eighteen years, for which office, post, or employment an oath, affirmation, or declaration of allegiance is required; or

(5)–making a formal renunciation of nationality before a diplomatic or consular officer of the United States in a foreign state, in such form as may be prescribed by the Secretary of State; or

(6)–making in the United States a formal written renunciation of nationality in such form as may be prescribed by, and before such officer as may be designated by, the Attorney General, whenever the United States shall be in a state of war and the Attorney General shall approve such renunciation as not contrary to the interests of national defense; or

(7)–committing any act of treason against, or attempting by force to overthrow, or bearing arms against, the United States, violating or conspiring to violate any of the provisions of section 2383 of Title 18, or willfully performing any act in violation of section 2385 of Title 18, or violating section 2384 of Title 18 by engaging in a conspiracy to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, if and when he is convicted thereof by a court martial or by a court of competent jurisdiction.

(b)–Whenever the loss of United States nationality is put in issue in any action or proceeding commenced on or after the enactment of this subsection under, or by virtue of, the provisions of this or any other Act, the burden shall be upon the person or party claiming that such loss occurred, to establish such claim by a preponderance of the evidence. Any person who commits or performs, or who has committed or performed, any act of expatriation under the provisions of this or any other Act shall be presumed to have done so voluntarily, but such presumption may be rebutted upon a showing, by a preponderance of the evidence, that the act or acts committed or performed were not done voluntarily.

It is also important to mention that if Mr. Obama was born to an American mother overseas he would still be eligible to be president because he would still be considered naturally born. It is only when the son or daughter is born to a father does it become a question of proving paternity. This is pretty obvious.

On a final note, John McCain is also eligible to run for president. They both are, this is nonsense.

I enjoyed reading your comments. Here are some items that might be worth considering, however.

It is really important to get the legal facts correct in this case as all of the action items in the complaint WILL be heard by the Federal Court (by a judge appointed by President Clinton, incidentally) in at least one jurisdiction, and most likely by me-too suits in all the US Districts. For many people, there will be too much at stake to win or lose.
This is really a very serious, non-trivial problem which will be resolved by attorneys in one or more courts of law, not by public opinion, and certainly not by yours or mine.
However, I do understand the passions involved here!

1. Unfortunately, you are looking at CURRENT US law, not the law that was in force at the time that Barack (Barry) Obama (Soetoro)was born in 1961. If you do a quick search at a law library or on Lexis or Westlaw you can readily confirm this. Lots of blog sites have provided the actual law in force at the time – under which IF Barack was born outside of the country to an American citizen 18 years old he would NOT be a “Natural Born Citizen” under the Article II provision of the Constitution governing the eligibility requirements of the office of the President. This item is settled law and not currently debatable.

2. Assuming, however, that the 1961 State of Hawaii’s COLB (Certificate of Live Birth)issued to Barack Obama is correct, the concern over documentation then becomes one of how the birth was reported to the Department of Vital Statistics. If Mr. Obama were born in a Honolulu hospital, the hospital would automatically create the original written Birth Certificate, and submit it to the State. If, however, he was born, say, in Kenya, and his mother returned to the US shortly thereafter, his maternal grandparents could submit an original signed birth certificate to the State themselves, using their own address as the place of birth. This was not uncommon in Hawaii at that time. It would, of course, be a fraudulent filing, and a subsequent US Passport issued to the holder would also be fraudulently issued. It is, of course, possible, that Mr. Obama himself was told as a child that he was born in Hawaii and has assumed that this is true. However, it would not change the fact of non-US birth in this case. Unfortunately, it has been stated that a birth certificate was located in Kenya and that 3 of Mr. Obama’s paternal relatives were present at his birth in Africa.

3. Photographic records of Barack Obama’s Catholic school registration in Indonesia show his name as Barry Soetoro, his citizenship as Indonesian, and religion as Muslim. As it has been reported that Lolo Soetoro, his stepfather, legally adopted the child Barack/Barry, he would have become a dual citizen. Contemporary commentary at the time that Article II and subsequent enabling legislation was written (1789-1789) make it clear that the legal intent of the “Natural Born” clause was to eliminate the possibility of the President service two masters or states or sovereigns – potentially in conflict with each other – in particular if, as Commander-in-Chief the President would be caused to attack his other country and his other allegiance. This is clearly a potential conflict for and dual national citizen, whether born on US territory or overseas by two US parents, and a challenge at the US Supreme Court would be unclear as to its ruling in any other way.

4. When Mr. Obama traveled at 20 to Pakistan, that country was on the no-travel US State Department list (which included North Korea and Cuba, among other countries). To reach Pakistan, it is reported that he used his Indonesian Passport under the name Barry Soetoro. This action, if true, would threaten not only his ability to serve as President but also as a US Senator. See Lexis/Westlaw for applicable case law in District 1, among others.

5. More troubling, however, is that Mr. Obama has signed, under penalty of perjury, on his application to join the Illinois State Bar in front of the Illinois Supreme Court, that he never previously had nor used any other names. This, of course, is not true. The law also does not care whether his previous names were only used when he was a minor child (and this also assumes that he never had a passport issued by the Indonesian government and traveled under it to Pakistan).

6. For the counter argument concerning John McCain (and I am NOT a supporter of his), there is no equivalency. Under the previous as well as current law (in fact, going back to the creation of the American military in the 18th century), a person born to two US citizens, one of which is serving in the Armed Forces or at a US Embassy overseas, is automatically born as a “Natural Person”. The law is also settled on this matter. Again, see case law on Lexis.

The problem with non-attorneys is, of course, that people are generally not familiar with the law, nor the case law that actively rewrites the law itself. Normal logic and common sense often suggest one thing and a court of law finds another. In other words, the law is often an ass – but it is still the law, and wishful thinking will not make this issue go away. Let’s hope that the documentation can be provided quickly or this has the potential to develop into a real crisis within the Democratic Party and perhaps even at a Constitutional level.

The purpose of this lawsuit is to run out the clock on Obama running for President, therefore leaving Hillary as the only candidate from the DNC. Remember, Hillary never declared defeat and is technically still in the running!

Judges, under their oath of office, are required to halt any potential illegal action when the possibility of such action comes to their knowledge.

Obama becoming President, if he turns out to be ineligible, is clearly against the law.

Therefore the judge, in order to prevent a crime from taking place, will have to either rule on Obama’s citizenship status before the primary election or place an injunction on Obama from running for President until this issue is resolved.

I am not sure that he even has standing to file the lawsuit. I doubt very much the district court even agrees to hear the petition. He has met the injury and possibly the resolvability requirement, but has failed to show causation because of overlapping arguments that are divisive in nature. You can’t argument to the court that the cause of your action is either A or B and in this case maybe C. You have to pick an argument and stick with it.

This case goes nowhere.

Why doesn’t Obama just produce an original birth certificate, and we can all stop speculating.

He just spent a week in Hawaii and had plenty of time to stop all of this nonsense.

Correct. Even if the allegations are true, this suit is premature.

Tony, thank you for telling me that I am not an attorney. It was of further help for you to break down of essentials of the material posted to numerous PUMA sites throughout the internet. I almost think attending law school may have been a waste of time.

Still, why not truncate the arguments even further that Mr. Berg claims in his petition:
1. Is not a natural-born citizen; and/or
2. Lost his citizenship when he was adopted in Indonesia; and/or
3. Has dual loyalties because of his citizenship with Kenya and Indonesia.

The final argument is not valid because it is an opinion. There is no contextual basis. It will not be discussed here.

The second would on the surface appear to be a valid argument. There, however, are problems with the so-called illegal nature of dual citizenship. It is by no means forbidden. Case law dating back to the late 1700s is not really a valid point, because of the changing nature of case law.

Court cases finding dual citizenship legal:
Afroyim v. Rusk, 387 U.S. 253 (1967)
Vance v. Terrazas, 444 U.S. 252 (1980)
Miller v. Albright, 523 U.S. 420 (1998)

There is no mention of dual citizenship in the Constitution. The finding out of the Court in 67′ was that an individual was entitled to dual citizenship following the 14th amendment. This would be applied retroactively. It would not matter if he was born in 61′.

I was further not aware that the US Codes on immigration were not retroactive. Many amendments to the codes are. I know the 1994 and 1996 amendments are. I will have to take a further look. As it stands, his first argument might be valid. It is doubtful, however, that his certificate was forged. I would further be suspect of alleged copies that turn up (suspiciously located at opportune time).

I still believe he lacks standing. I do not believe that it matters if the judge was a Clinton appointee. I still believe he has a problem with causation. The redressability is further questionable because of the motives of Mr. Berg. This can be construed based on the filing of multiple, different arguments that do not relate, but rather tanamount to him throwing the kitchen sink at Senator Obama. This almost borders on the realm of a political question because there simply is no adapeduate standard to address the case, nor would the lower court feel that it was prudent to interfere.

Finally, I never said that Senator McCain case was based on the same legal context. What I simply said was that neither had any real motivates outside of political motivations. It, however, would be correct to conclude that Senator McCain is a citizen by all definitions of the law and Senator Obama has a more questionable past. I just don’t believe that it rises to the level of disqualification.

If you are born in Hawaii after it became a State you are a citizen, natural born and otherwise. If you have a birth certificate from Hawaii saying the same, it will take “clear and convincing evidence” of a fraud to overcome the presumption of the authenticity of government records.

That is a very high burden to meet. Impossible if you get a democratic judge.

There is no merit to these claims in the lawsuit. This is only a ploy by the GOP to get a discussion started that will make people suspicious of Obama’s loyalties/citizenship/integrity.

Jeff — You may be a lawyer, but you are mistaken that having multiple theories to support granting the requested relief negates all the arguments. Lawyers do it all the time. Especially in a case like this, where the essence of the case is to compel discovery, alternate theories may be alleged and discovery determines which of the competing theories, if any, prevail.

EITHER Obama was born in the US, OR he was not.

Whichever the situation, it is argued in the Complaint that Obama is not qualified. It is impossible to know what situation is the true one until discovery goes forward.

Those of you who want to understand or don’t understand the suit and the surronding law–read.

First, Attorney Berg, is not a joke, he is a former Pennsylvania’s deputy attorney general and former DNC state officer.

As for the suit, it is simple, certificate that Obama has been using in a certificate of live birth, different from a Birth Certificate. All it means is Obama was born alive does not mean he was born in Hawaii. When all U.S. Born citizens are born we get a birth certificate, the one they send us home with and the one the government sends us (one pager), but the one the Government has on file of each us is a long form that has lots of info on it, this has yet to be seen. Other irregularities have also popped up, the fact that one of the fakes used by the Obama camp was in Arial Font, not used in 1961, or the term African American, also not used then, “Negro” would have been the term then. Also problematic is the fact that Obama was adopted in Indonesia, a country that does not recognize dual citizenship, there are many other issues here including Obama’s mother being 18 (law requires 21), which made her by law, ineligible, to automatically pass her citizen ship to Obama. There are questions if Obama mother was ever married to Obama’s Kenyan father, especially since he was suppose to already be married in a woman in Kenya. Also, since he was adopted and held a Indonesia passport up to the age of 20 and was using it(passport obtained a as a result of his adoption), and that his biological father’s family says he was born in Kenya (newspapers in Kenya have run articles to that fact as well as Israel papers and other international papers, see link below). There are many other problems including but not limited to the fact that there is no record of Obama after the adoption and relocating back to the states of a U.S. citizenship swearing in ceremony renouncing other loyalties (ie, Indonesia, Kenya, and Canada). Apparently a Canadian certificate of birth has also surfaced.

It’s simple, its simple Barry needs to go to court, provide documentation, evidence, witness interviews, immigration records, etc, clear it up or resign. The Constitution is clear and the laws were put there for reasons of national security. The Constitution must apply to all, of the value of democracy is lessoned.

If BHO has a legitimate birth certificate and all of the documentation to prove his actual US citizenship then why does he not just provide it and be done? Case closed. To me this seems the best and easiest course of action. I am no lawyer and dont know about many of the things mentioned here. If Berg has been practicing law for 37 years as he has stated, then I would assume he would know of what he speaks. If this was a frivolous suit then why would the judge rule against the move for dismissal? As a reasonably logical thinking man, I would expect that the documentation in question would just be submitted and done. If I am pulled over and asked for proof of insurance I dont pull out a printout of the insurance agency’s website. I have to have actual proof. I guess I just dont fllow the arguments here. As everyone is well aware Obama’s grandparents were US citizens, his grandfather was a WWII veteran. Obama’s mother was a US citizen. Any child she gives birth to is a US citizen, even when the birth occurs in another country, as is the case today with parents who are living abroad on business or missionary work for example.
Obama was born in Hawaii.
US citizens who travel abroad retain their citizenship, even if they use a native name or file required paperwork while in the non US nation. They retain the rights, privileges and obligations of US citizenship ( The IRS wouldn’t have it any other way).
With these facts well known the lawsuit filed will be found to have no merit. An action that has no merit will not require the disclosure of any further documentation.
End of story.

Addressing a few of the things I’ve read on here.

1. The use of the middle name: It’s been standard procedure for decades to use the President’s middle name and at the very least, the middle initial. 3. Why is this coming up now?: Plenty of reasons it could be now. First of all, it takes time to put together these lawsuits. In this case, 30 days had to pass to allow Obama time to respond. If the Republicans are behind it, you are going to release this when it has the chance of doing the most damage and causing the most mayhem. If they had done this before the Dem convention, they may have sunk him then and they would have been running against Hillary. This way, they could wait to see if Obama get’s the nomination and then spring the news late so as to not allow the opposition much time to regroup in the even Obama is forced to withdraw. Actually, it’s great strategy and the Dems would have done the same thing…….You know damn well they would have!!

Honestly, I thought this was just a “conspiracy theory”, but after reading the actual court documents, my opinion is shattered. I don’t want McCain, but I honestly think that the constitution has to be upheld above all, otherwise, no future politician will adhere to it. Re: If Barack is a natural born citizen why can’t he just end this question by releasing one simple document…A birth certificate not a certificate of live birth an actual Birth certificate.

Who, other than you and some other bloggers have asked to see Obama’s original birth certificate? In other words, how does Obama know that there is a “question?”

He provided the certification of live birth, which he may have assumed was good enough — since the officials of the state of Hawaii said it was good enough and the US state department accepted it as proof that he was a US citizen to get a passport.

So how does Obama know that there are any questions?

If a court had asked for it, or the DNC had asked for it, or a state board of elections had asked for it, that would be a different thing. Then he would have known that the certification was not good enough, but so far he thinks it is good enough, AND MAYBE IT IS GOOD ENOUGH.

Besides, why provide additional documents when (1) the certification of live birth is evidence that he was born in Hawaii and (2) there is no evidence that he was born anywhere else than Hawaii?

Prove that he was born somewhere else than Hawaii, and you can say that he is covering up something.
