YOUTUBE SEEMS to be thinking that it is better to censor videos that talk about evolution than it is to deal with all the religious loonies demanding that they take them down.
Latest in the purge was a group called the Rational Response Squad which is incandescent with rage that bible bashers managed to shut them down with spurious DMCA claims.
According to Richarddawkins.net the outfit has made it its mission to send shedloads of take down request to anyone who does not agree with Hovind’s interpretation of the Bible. Particularly those Evolutionists who quote Hovind’s own words as evidence of what they believe. Hovind is on record saying all the material at his site is not copyrighted. But when the evolutionists quote him in their YouTube posts his followers claim that it belongs to them.
Hovind’s disciples are exploiting a loophole in the DMCA which forces a takedown without any review. It becomes up to the defendant to prove that it is their copyright and that is a long and expensive process.
The “Herman Munster ” like photo reminds me of Herman Munster off to buy a new (or new used) car.
Herman goes to a used car lot where the manager sits in a tent (today it would be motor home or fancy Winnibago) or a S.U.V. (ready to bolt).
The car salesman shows Herman a foreign auto – a Volkswagen Bug car (small horsepower air cooled gas motor was in the trunk).
The salesperson tells Herman – this car was driven by a little old lady in Sacramento only to Church on Sunday.
Herman looks at the Volkswagen Beetle’s engine in the rear trunk of the car and remarks ” And indeed she left her sewing machine in the trunk”
Creationists maintain the political traditions of their species, that’s all. The BeanCounters in charge of YouTube do the same.
I don’t think the process to contest the take down notice is THAT expensive or long–but like the original article, I lack specifics on that.
Nonetheless, what else is a “fight” about?
The televangelist Benny Hinn also uses DMCA unethically to stifle criticism of his shenanigans on youtube.

I don’t think the dmca is at fault here. It is trying to strike a balance between making info available while protecting copyright material. If the original posters are not willing to defend their postings, then certain groups will abuse the take down provision. It would not take too many counterclaims to break this nefarious behavior, a good job for the ACLU if they weren’t so busy elsewhere.
Way to go Bill Clinton. Just another great feature of your legendary DMCA.

You are forgetting that Sen. Orrin Hatch (R) of Utah and Rep. Howard Coble (R) of NC are the ones who brought forth this crap legislation. Check it out on http://thomas.loc.gov for the 105th Congress. Both stupid parties supported the DMCA…

#7, #8 True, but the President has the ultimate responsibility to sign or veto crap legislation. The fact that he happily affixed his signature to the legislation makes the DMCA Clinton’s legacy.
So where are all the mainstreams churches in all this, who agree with the theory of evolution of think its good science? Can’t they round up the creationists believing heretics and try them for treason or something? That’s the problem with Christianity these days, ever since the bleeding heart liberals got rid of the Inquisitions there is no doctrinal unity anymore…. half an hour on a flaming stake will take care of these bible bashers….

In ANY debate, there are two things that are ALWAYS at fault… Fundy Xians, and the DMCA.
So yes, the DMCA is at fault here like it is everywhere…
Knowing how much paperwork fundie Christians can make (look at the mass of complaints they make to the FCC), maybe they will fix the DMCA because of this. Frankly, there needs to be a review of some kind before a takedown. Quoting a source is FAIR USE and YouTube should realize it.
This isn’t YouTubes fault – it’s the people that file the DMCA’s YouTube has a responsibility to take the content down (its the law, don’t like it? change the law)
However…
1) Counter claims are easy to file and youtube will bring up the video until it is settled usually (and they even spell out how to file a counter claim in their email to you).
2) Knowingly filing a incorrect or fraudulent DMCA claim is illegal, and can result in heavy fines, or jail time. I guess the Hovind ppl want to get sued/arrested… I know I would report them if this happened to me.
Hovind offfers “$250,000 to anyone who can prove to his satisfaction that evolution happened.” I hereby make a counteroffer. I will give $1,000,000 to anyone who can prove (to my satisfaction) that God exists.
I dont see this going anywhere constructive.
I can only hope that this loonie gets a highly contagious form of TB – then he can ponder the wonder and truth of evolution while the drug-resistant microbes devour his body.
