Out-of-control Diet
A New York federal judge on Monday tossed out a lawsuit by a Florida man against the company behind the Atkins low-carb diet that he alleged caused his cholesterol to skyrocket and necessitated an angioplasty.
Jody Gorran, 53, of Delray Beach, Florida, went on the Atkins Diet in 2001, admittedly eating mainly pastrami and cheesecake. After just two months, his cholesterol shot up to an unhealthy 230 from a low 146, according to the suit.
“Pastrami and cheesecake — large amounts of which Gorran admittedly consumed — may present risks, but these are risks of which consumers are aware,” wrote Judge Denny Chin in his dismissal of the suit.
The diet consists of only “advice and ideas” that are protected by the First Amendment, Chin wrote.
Gorran had sued Atkins Nutritionals Inc. claiming its products were “defective and unreasonably dangerous,” seeking money damages and an injunction requiring the company to put warning labels on all of its products and its Web site.
As I’ve said before, this is attempted “extortion by lawyer”.

Is Cheesecake even on the Atkins diet?
I did pretty well with the Atkins diet, but thats mainly because most junk food has carbs. Low carbs meant low junk food.
That picture….
If beauty is in the eye of the beholder, than someone needs an eye transplant. Yow!
i pitty the chair
2,
That picture doesn’t even FIT in my eye… But, since she’s smoking, it’ll all just melt away.
Great photo, Eideard, and this can be a test for all those who continue to proclaim that sexual attraction is a conscious choice. For all we know, this woman may be a very warm and loving person with many fine qualities. How many Christians (or other gay bashers) know beyond any doubt that they could choose to find this weight-challenged woman very attractive?
I’m sure someone will be attracted to her, but I don’t think it will be by choice. It will be a natural tendency they don’t quite understand, and I hope she’s lucky enough to find him or her.
wanna bet it’s a Diet Coke she’s drinking?
#5 – you, my friend, need a life.
As to the subject at hand, I’ve “done” Atkins twice – both times I lost a good bit of weight, felt better, blood pressure was down to “good” levels, lower HDL, etc.
It’s a matter of using some common sense, which people like me who actually READ the book realized that Dr. Atkins was promoting. The “eat all steak and lose weight” part is only to get you started for a couple weeks – after that you get to a normal eating cycle that is very good for you.
My problem with it is that I don’t have the self control to avoid the bad foods. I don’t smoke, drink, do drugs, have extra-marital sex, etc – I gotz to have my one vice!
#7, my “inconvenient truths” are meant to irritate. They’re also meant to make you think. Something tells me I’ve only achieved half my goal 😉
5,
Don’t worry. There are chubby chasers out there. Focus helping humanity in more productive ways.
#8 – I didn’t get irritated, so I guess you failed on both! 🙂
To be honest, though, there are cultures where someone of this fair maidens, eh, “stature”, is considered a good thing.
Attraction is always a choice – I decide all the time that someone is more or less attractive based not solely on their appearance, but also their attitude, etc. We also tend to cultivate our own attractiveness choices – I like women with nice curves (I’ll leave it there!), and chose to increase my liking of that since I was old enough to realize that I actually liked cooties.
If I understand the Atkins diet correctly, you are restricted to meats and non-starchy vegetables. So there’s no way the Atkins diet would condone cheesecake. IANAL, but it sounds like Jody Gorran does not have a strong legal case.
#11 – cheesecake is allowed, once you enter “Phase two” – but only if made with Splenda and a crushed nut crust.
I personally still like the Cheesecake factories “Low carb” cheesecake even though I’ve been off the diet for a year. It’s not too sweet – quite good and only 8 carbs per slice (and it’s a decent size slice).
The other stuff in cheesecake is generally low or no carb anyway – it’s the crust and added sugar that make it “bad” – so when you eliminate those, it’s on the diet (in moderation, of course!)
The problem is we in America can’t seem to grasp “In Moderation” – just like that idiot “Super Size Me” fool. That guy, Sperlock or something, is a class A jackass. I’ve watched him on TV and on this other thing about minimum wage and the thing I’ve come away with is that he is a self-righteous gasbag that needs a couple guys to give him a good beating.
But that’s just me.
#5, Good analogy and I only wish others understood your point. But of course, they are too busy defending their choice of diets to bother contemplating another thought pattern.
What is with these pictures of unattractive women as of late? I come to Dvorak Uncensored for the scantily dressed, attractive, women!
dear?
Dear…
NO, dont role over,
Nooo..
DEAAR wake up, DONT ROLE OVER…
AWWwwwwW!!!
mumble mumble snort…
#14, the solution is simple — just choose to find them attractive, and voilà , you’ll be coming back for more!
#15 ECA, once in awhile you really crack me up 😉
Hooray for personal responsibility.
Weight challenged… ha! more like self control challenged.
On the topic of the article (not the image) I’d strongly agree with the post of #7. I am no way related to Atkins (and even do not use their products in the process) but I have sucessfully been on the “Atkins diet” for a bit more than a year. Mainly because I first read-up and learned the science behind it.
“Catch” is in the strict adherence to it. Unlike “calorie conting” diets, Akins alters the metabolism and any seemingly small “violation” of what you eat when doing something so drastic can hurt you. It’s not just coming back to it next day. And as the user #7 points Atkins is not what the common word-of-the-mouth takes it to be (just eat steak all the time).
My own results were totaly corresponding to the science behind it. I lost weight AND decreased my cholesterol for about 30% over one year with no cholesterol medication (277 total to 195 total)… That is what should happen with any proper Atkins dieter. Hence, based on the science of it this lawsuit should be dropped. Claimant simply was not using Atkins diet because his cholestrol went up! However, potential users must be warned to first learn a lot about the diet and see if it suitable for them. Real dangers lie in the liver and kidney functions (from the science of it). If lawsuit was about liver or kidney damage I’d be more symphatetic to the claimant. However if your cholesterol raises up while on Atkins, you are doing something wrong!
(PS: normal cheesecake is not the part of the Atkins diet. You can’t have even a teaspoonfull of it. Variety of meats and more importantly variety of green leafy vegetables is the core of it.)
#5 – I’m sure someone will be attracted to her, but I don’t think it will be by choice. It will be a natural tendency they don’t quite understand, and I hope she’s lucky enough to find him or her.

Did you just join society yesterday? 🙂
There are people enjoy being wrapped in latex – licking a woman’s boots – being urinated and shat upon – and as if that isn’t bad enough, some people are sexually attracted to children…
Yes. Somebody – many somebodies – are attracted to the grotesquely obese…
I prefer my women a little less Planetoid, however…
#19 OFTLO, as with you, within certain boundaries, my attraction to a woman is inversely proportional to her measurable gravitational force. I’ve always thought that being able to create a high tide is just showing off 😉
That bikini looks like a safety hazard. A restraining cable snapping on an overloaded pulpwood truck comes to mind. But, besides if you need chains to assure the load bearing integrity of your swimsuit you just aren’t bikini material. That goes for guys too. If you have ever had a whale watching eco-tourism boat move rapidly in your direction at the beach, or people on that boat offer to help get you back into the ocean, no Speedos for you!
My Doctor wants me to try the head diet. He claims you may lose 40 lbs of ugly flab instantly. All you have to do is cut off your head. My wife also wants me to try it for at least a week. Some people feel a little light headed at first, but get over it pretty quickly.
Out-of-control Diet
Caption of the month, Eideard! 🙂
Thanks for the warning on that picture. The eye bleach does nothing. The eyes are still bleeding.
All im saying is heat in the winter, shade in the summer. I tried a skinny one once got a bruise so bad ended up in doctors office.
OK,
I want you guys to do something that I havent been able to find…
Find on the EPS site where Canola(rape seed oil) and Soy CAN be used as a food product.
From what I have heard,
Both are poisonous plants and have NOT been OK’d by the EPA..
This could explain ALOT..
