Throughout the United States, judges have forbidden defense attorneys from informing juries that they have a right to nullify the law based on their dislike of the law. In California for example, jurors are required to inform on other jurors if one of them argues that the law is bad. The judge will then replace that juror with an alternate. A defense attorney who argues on grounds of nullification could face disbarment or other sanctions by the court, even though nullification is a right all U.S. jurors poses under common law.

On June 18, New Hampshire Governor John Lynch signed HB 146, which reads: “[A] Right of Accused. In all criminal proceedings the court shall permit the defense to inform the jury of its right to judge the facts and the application of the law in relation to the facts in controversy.”

I have the feeling this New Hampshire law will end up having a tremendous effect on the American judicial system as a whole. If enough people start nullifying drug laws in New Hampshire, eventually New Hampshire prosecutors will be forced to stop prosecuting drug offenses in that state entirely. In 2010, a Montana case never even made it to trial because prosecutors could not find enough people who would be willing to convict a person based on drug charges.

Last summer major ISPs including Comcast, AT&T, Verizon and Cablevision signed off on a new plan by the RIAA and MPAA taking aim at copyright infringers on their networks. According to the plan, after four warnings ISPs are to begin taking “mitigation measures,” which range from throttling a user connection to filtering access to websites until users acknowledge receipt of “educational material.” As you might expect, that educational material’s chapter on fair use rights likely won’t exist.

The plan, as with most plans of this type, was hashed out privately with the government’s help — but with no consumer or independent expert insight. As a result groups like the EFF say the plan has massive problems, like relying on the IP address as proof of guilt, placing the burden of proof on the consumer, while forcing users to pay a $35 fee if they’d like to try and protest their innocence.

“Hashed out privately with the government’s help.” More and more our government has simply become a clearinghouse for business to do whatever it wants.

Thinking critically might lead to people questioning politicians and religion and other things that keep them slaves to their masters who know better how to control their lives. Can’t have that!

The Republican Party of Texas’ recently adopted 2012 platform contains a plank that opposes the teaching of “critical thinking skills” in schools. The party says it was a mistake, but is now stuck with the plank until the next state convention in 2014.

The plank in question, on “Knowledge-Based Education,” reads as follows:

We oppose the teaching of Higher Order Thinking Skills (HOTS) (values clarification), critical thinking skills and similar programs that are simply a relabeling of Outcome-Based Education (OBE) (mastery learning) which focus on behavior modification and have the purpose of challenging the student’s fixed beliefs and undermining parental authority.

In an effort to cut down on drunken driving, the state is distributing the totally awesome named Interactive Urinal Communicators to some bars, restaurants and other drinkaterias in Wayne, Bay, Ottawa and Delta counties.

Yup, talking urinal cakes.
